Council Slams “Wasteful” Saga After Tenant Blocks Access for Nearly Two Years.
Havering Council has criticised the “wasteful and unnecessary drain on public resources” caused by a long-running battle to gain access to a tenant’s property for a routine electrical and asbestos safety check.
What should have been a simple appointment turned into an 18-month legal saga.
Despite a court order issued in January 2024, the resident repeatedly refused access. A second court order in July 2025 was then required, finally allowing the Council to force entry.
When officers arrived in August 2025, supported by three contractors, two police officers, two council officers and a locksmith—the tenant still refused to cooperate. After 40 minutes of discussion, they eventually agreed to let the safety work take place.
Councillor Ray Morgon, Leader of Havering Council, said:
“This is a deeply frustrating example of how much time, money, and effort can be wasted when we’re simply trying to fulfil our legal duty to keep our tenants safe.
As a responsible landlord, we are absolutely committed to the safety of our tenants. This includes ensuring our properties have up to date gas, electricity, water and asbestos checks. We should not be prevented from meeting these statutory obligations.”
Earlier this year, the Council introduced a new Access to Homes policy and additional training for housing staff to make sure safety checks are carried out efficiently and respectfully.
All council tenants sign an agreement setting out both their rights and their responsibilities, including allowing reasonable access for essential checks. Refusing access can breach the tenancy and may lead to legal action, possession proceedings and significant costs.
In this case, the Court has ordered the tenant to pay £4,000 in legal costs to Havering Council.
